All intellectual property rights in the Service including software, content, design, trademarks, and other materials are owned by Kumari AI or its licensors.

• Your Content: You retain ownership of the input you provide to the Service. By providing input, you grant us a license to use it to provide and improve the Service (subject to your privacy settings).
• Service Outputs: Subject to your compliance with these Terms, Kumari AI hereby assigns to you all its right, title and interest in and to Output generated by the Service based on your Input.

To the maximum extent permitted by law:

• Kumari AI is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim will not exceed the amount paid by you in the 12 months preceding the claim.

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or our Policies.

• We will attempt to provide notice unless the violation is severe or creates legal risk.
• You may stop using the Service at any time by closing your account.

We may update these Terms from time to time.

• For material changes, we will notify you via email or a prominent notice.
• Your continued use of the Service after changes constitutes acceptance.

These Terms are governed by and construed in accordance with the laws of Delaware, United States. Any disputes shall be resolved exclusively in the courts of Delaware, United States.

You agree to defend, indemnify, and hold harmless Kumari AI, its affiliates, and its personnel from and against any claims, losses, and expenses (including attorneys' fees) arising from or relating to your use of the Service, including your Content, and your violation of these Terms.

THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE OR ANY CONTENT THEREIN.

• TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Mandatory Arbitration: You and Kumari AI agree to resolve any claims relating to these Terms or the Service through final and binding arbitration.

• Class Action Waiver: Disputes must be brought on an individual basis only, and may not be brought as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

• Generating or distributing illegal material.
• Promoting or facilitating violence, terrorism, or self-harm.
• Engaging in harassment, hate speech, or discrimination.

• Attempting to bypass safety filters or 'jailbreak' AI models.
• Automating the creation of malware, phishing scams, or spam.
• Scraping or extracting data from our Service without authorization.

• Creating deepfakes or misleading AI-generated content intended to deceive.
• Impersonating individuals or organizations without authorization.
• Facilitating automated disinformation campaigns.

You may cancel your subscription at any time through your Account Settings.

Upon cancellation, you will retain access to premium features until the end of your current billing period.

No partial refunds will be issued for unused time within a billing cycle.

All purchases and subscription payments are final and non-refundable.

By subscribing to Kumari AI, you acknowledge and agree that:

• All fees are non-refundable, regardless of usage or satisfaction.
• You are responsible for managing your subscription and canceling before renewal if you no longer wish to continue.
• No refunds will be provided for partial billing periods, unused features, or failure to cancel before renewal.
